The Tendai Ndoro and Ajax Cape Town application to the Johannesburg High Court to set aside the Safa arbitration ruling has been dismissed, meaning the Zimbabwean is still ineligible to play.
The Premier Soccer League Disciplinary Committee initially dismissed the protests filed against them by Orlando Pirates and Polokwane City.
The sides logged a protest against the Urban Warriors for fielding Tendai Ndoro at the beginning of 2018, as the striker had played for three clubs this season – Orlando Pirates, Saudi Arabian club Al-Faisaly and Ajax – contravening Fifa’s regulations on the status and transfer of players.
Safa arbitrator Nassir Cassim then referred the decision to Fifa and also decided to bar Ndoro from playing pending the outcome of his eligibility case. Cassim ruled that the PSL Dispute Resolution Chamber, which had cleared Ndoro earlier and allowed him to play, did not have jurisdiction on the matter.
The former Chicken Inn striker then made an appeal at the Johannesburg High Court to hear the matter urgently as he claimed that the decision stopped him from earning a living.
The court, however, decided to dismiss the appeal, leaving both Ndoro and Ajax waiting on the Fifa ruling.
